Pakistan S Defense Ministry Tells Supreme Court No Right to appeal for kulbhushan jadhav

Kulbhushan jadhav case: A shocking statement has come out in the Supreme Court of Pakistan regarding Indian citizen Kulbhushan Jadhav. Pakistan’s Defense Ministry lawyer Khwaja Haris Ahmed said that Kulbhushan Jadhav was not given the right to appeal despite the International Court of Court (ICJ), as the ICJ had ordered only the “counselor access”.

In fact, this comment came at a time when a constitutional bench of the Pakistan Supreme Court was hearing cases in which the accused of the May 2023 riots were convicted by Pakistani military courts. Jadhav’s case was raised in this context, to show that the rights given to him are not getting the local citizens.

ICJ asked Pakistan to reconsider
Indian citizen Kulbhushan Jadhav, who is in jail on charges of espionage in Pakistan, has not yet been allowed to appeal. In June 2019, the International Court of Court (ICJ) gave a verdict in favor of India and said that Pakistan should reconsider Mr. Jadhav’s sentence and death sentence. Along with this, they should also be allowed to meet the officials of India.

India says that Pakistan did not fully follow the ICJ’s instructions. In July 2020, India clearly stated that Pakistan has refused to implement the ICJ’s decision. India also alleged that the trial given by Pakistan was completely beyond transparency and justice.

Jadhav case mentioned in Pakistan Supreme Court
Pakistan’s lawyer Khwaja Haris Ahmed mentioned the Jadhav case during the hearing of a case in the Supreme Court. The lawyer argued that the appeal given to Jadhav was not given to his own citizens, who have been convicted by military courts for joining the “Black Day” riots of 9 May 2023.

According to the Dawn newspaper, Pakistan’s Attorney General Mansoor Usman Awan has sought time from the court so that they can consider the issue of giving the rights of the riots to appeal. This raises the question whether Pakistan is implementing rules for foreign nationals in a different way due to international pressure?

India’s stance and next step
Let me tell you that India has always said that Kulbhushan Jadhav was abducted from the Chabahar port in Iran, and Pakistan alleged that he was arrested from Balochistan, false and concoction. India also believes that Pakistan has violated the Vienna Convention and contempt the orders of ICJ. The Government of India is constantly raising the matter on international forums and is demanding to fully follow the ICJ’s decision.
